Lights to be displayed by aircraft

(1) Except as provided by subregulation (4) and unless the aircraft was initially type-certificated without such lights or is a non-type certificated aircraft approved without such lights, all aircraft shall display—

(4) A pilot shall be permitted to switch off or reduce the intensity of any flashing lights fitted to meet the requirements of subregulations (1), (2) and (3) if they do or are likely to—
